NOTICE OF PUBLIC HEARING FOR AN APPLICATION FOR MINOR VARIANCE Statutory Authority: Section 45 of the Planning Act .1990

To provide relief from:
1) Section 5.11.1 ii) of the Township of Limerick Zoning By-law

No. 2013-20 to permit an increase in gross floor area of 41.34 m2, allowing a total gross floor area of 124.95m2, and an increase in building height of 1.58 metres, allowing a total building height of 5.181 metres;

2) Section 8.3 a) vi) to reduce the setback from the high water mark from 30 metres (98.4 feet) to 7.6 metres;

3) Section 5.9.2 i) to reduce the setback from 30 metres (98.4 ft.) of the high water mark of a water body or permanent watercourse, to 7.6 metres;

4) Section 8.3 a) iii) to reduce the minimum front yard depth from 10 metres (32.8 ft.) to 5.57 metres .

The proposed variances are requested in order to permit demolishment of the existing building and construction of a new structure. The owners wish to rebuild on the existing footprint and expand the cottage to the rear and west sides to increase the overall footprint to 1345 sq. ft. or 124.95 m2

The existing cottage is 15′ high. The addition will have a loft and the total overall height will be increased to 17 ft.

TAKE NOTICE that the Township of Limerick Committee of Adjustment will hold a Public Meeting on January 16th, 2017 at 1:00 p.m. in the Council Chambers, located at the Limerick Community Centre at 7645 Hwy 620, consider a proposed Variance under Section 45(1) of the Planning Act for the above noted application, numbered as A007/16.

The subject lands are not the subject of any other application under the Planning Act.

Public Hearing: You are entitled to attend this public hearing in person or you may be represented by counsel or an agent to give evidence about this application. Signed, written submissions that relate to an application shall be accepted by the secretary before or during the hearing of the application at the address below and shall be available to any interested person for inspection at the hearing. Statutory Powers Procedures Act.

Failure to Attend Hearing: If you do not attend this public hearing, it may proceed in your absence and, except as otherwise provided in the Planning Act, you will not be entitled to any further notice in the proceeding. Statutory Powers Procedures Act.

Notice of Decision: a certified copy of the decision, together with a notice of the last day of appealing to the Ontario Municipal Board shall be sent, not later than 10 days from the making of the decision, to the applicant, and to each person who appeared in person or by counsel at the hearing and who filed with the secretary a written request for notice of the decision. Planning Act, R.S.O 1990 c.P.13, s. 45(10).
