1.  To approve the minutes of the FOCA Annual Meeting held on March 5, 2016.

 

2.  To approve the audited Financial Statements of FOCA for the fiscal year ending September 30, 2016.

 

3.  * To approve revisions to the membership fee schedule, effective April 1, 2018, as recommended by the FOCA Board of Directors.

 

4.  To approve the slate of Directors recommended by the FOCA Nominating committee.

 

5. Any other matters that may come before the said meeting.

* Supplemental Information:

Per Agenda #3 – “Revisions to the membership fee schedule”
Motion: Effective renewals starting in April 2018, an increase of $0.25 in the per member fee (to $3.50 per member); and, a change to the maximum association fee, from $3000/year to $3150. The exception to the above will be for member associations with fewer than 10 members – there will be NO change to the fees for these associations.

Purpose of Application:

To provide relief from:

  1. 1)  Section 5.11.1 ii) of the Township of Limerick Zoning By-law No.

    2013-20 to permit an increase in gross floor area of 41.34 m2, allowing a total gross floor area of 124.95m2, and an increase in building height of 1.58 metres, allowing a total building height of 5.181 metres;

  2. 2)  Section 8.3 a) vi) to reduce the setback from the high water mark from 30 metres (98.4 feet) to 7.6 metres;
  3. 3)  Section 5.9.2 i) to reduce the setback from 30 metres (98.4 ft.) of the high water mark of a water body or permanent watercourse, to 7.6 metres;
  4. 4)  Section 8.3 a) iii) to reduce the minimum front yard depth from 10 metres (32.8 ft.) to 5.57 metres.

Effect of Application:

The proposed variances are requested in order to permit demolishment of the existing building and construction of a new structure. The owners wish to rebuild on the existing footprint and expand the cottage to the rear and west sides to increase the overall footprint to 1345 sq. ft. or 124.95 m2 The existing cottage is 15′ high. The addition will have a loft and the total overall height will be increased to 17 ft.

This application for Minor Variance has been APPROVED by the Committee of Adjustment, subject to the conditions as provided below:

  1. The proposed development is situated not nearer to the shore of Limerick Lake than the existing frame cottage;
  2. The applicants enter into and duly register on title a Water Quality Impact Assessment Agreement with the Township;
  3. The applicants obtain a development permit from the Crowe Valley Conservation Authority prior to initiating construction upon the subject lands;
  4. The applicants execute the purchase of the Shore Road Allowance across the frontage of the subject lands.

FOR THE FOLLOWING REASONS:

  •   The general intend and purpose of the Official Plan is maintained
  •   The general intent and purpose of the Zoning Bylaw is maintained.
  •   The variance is considered desirable for the appropriate development of the land.
  •   The variance is minor in nature.

    Explanation of effect of written and oral submissions
    No oral submission were made during the public meeting.

    Written comments were received from the County of Hastings and the Crowe Valley Conservation Authority, which the committee received and concurred with. Correspondence was received from Mr. Edward Offshack in full support of the variance.

The applicant, the Minister or any other person or public body, to whom notice of decision was sent, may within twenty days of the making of the decision appeal to the Ontario Municipal Board against the decision of the committee by filing with the Secretary-Treasurer, a completed OMB appellant form, accompanied by the appeal fee payable by certified cheque or money order, in Canadian funds, to the Minister of Finance.

Only individuals, corporations and public bodies may appeal decisions in respect of applications for consent to the Ontario Municipal Board. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or group on its behalf.

If no appeal is lodged within twenty days of the date of the making of the decision, the decision becomes final and binding and notice to that effect will be issued by the secretary-treasurer.
